La pornografía: un “negocio” entre la legalidad y la ilegalidad - Pornography: a "business" between legality and illegality

Somos un país en el que este tipo de temas no se discute, se habla de la posibilidad de que las personas puedan vivir su sexualidad en el marco de lo que la Constitución política permite, pero cada cual lo entiende a su manera y acomodo. Mientras unas personas sacan partido de este lucrativo negocio desconociendo sus propios deberes y los derechos de quienes participan, otros se rasgan las vestiduras por lo inmoral del tema, unos terceros opinan que Colombia debe tocar la cuestión de la legalidad de las páginas webcam(1) que para unos cuantos no son completamente ilegales, para otros son legales, pero les falta regulación del Estado.

El código penal y las leyes son severas con la pornografía infantil, pero la realidad es que el Estado no presta atención sobre lo que realmente está pasando en los estudios(2), éstos se encuentran en el “limbo” pues no han sido legalizados, pero tampoco declarados ilegales. De hecho, la “actividad” de las empresas que producen pornografía en el país no está contemplada en la Clasificación Industrial Internacional Uniforme de todas las Actividades Económicas. Falta definir cuándo hay o no delito y empezar a visibilizar una problemática social; cuando esto suceda, se puede denunciar y por supuesto, se entraría en procesos de formación para entender las dinámicas que se están presentando. De hecho, el simple aviso de “el siguiente programa es apto para… No contiene escenas de sexo ni de violencia. Los menores deben estar acompañados de padres o adultos responsables” demandan un mayor desarrollo legislativo del tema.

Al hablar de regulación se piensa que esos lugares no se conviertan en riesgo de una cantidad de delitos, especialmente la trata de mujeres con fin de esclavitud y explotación sexual, abusos, extorsiones, daño físico, moral y psicológico, explotación de niños, niñas y adolescentes y dar garantías porque negocios tolerados o semi - legalizados, con la naturaleza clandestina de que gozan en su mayor parte, hacen que la criminalidad tenga un escenario fecundo para éstos y otros delitos.

Se podría entender que la regulación para la industria pornográfica sea específica porque no es una actividad ordinaria, sobre todo si se tienen en cuenta los riesgos que contiene y lo susceptible que puede llegar a ser su contenido para los menores de edad; pero la falta de regulación jurídica y económica abre una vía para malas prácticas que hasta el mismo gobierno ha aprovechado: a cualquier persona le puede parecer inaudito que ante el silencio cómplice frente a una “actividad” donde es difícil opinar por el hilo fino entre lo legal y lo ilegal; aplique un gravamen que permite recaudar dinero de las modelos webcam(4) para el Estado y a la vez que se convierte en cómplice de este tipo de pornografía, se afirme que el impuesto es una forma de regular el negocio y es una actividad moralmente nociva(5) que se debe regular para que disminuya(6).

La regulación pasa por empezar a visualizar este tipo de establecimientos, no es lo mismo un almacén que ofrece juguetes sexuales, imágenes sexualmente explícitas, películas o videos pornográficos a las paginas webcam que ofrecen exhibiciones en vivo. Los requisitos para estos negocios de entretenimiento para adultos son diferentes así nos encontremos con el derecho a la libertad de expresión(7), La falta de leyes vulnera no solo las barreras morales sino las normas de protección de los niños, niñas y adolescentes, avala el funcionamiento de sitios web con contenidos pornográficos, sin importar qué tan obsceno sea el material ofrecido al público, lo obsceno y pornográfico hay que evaluarlo y regularlo lo mismo que las garantías a las mujeres; la ilegalidad de estos espacios consiste en que este tipo de escenario se encuentra en total desprotección de parte del Estado que debería ser un garante de los derechos del ser humano; es una pena que Colombia siga siendo uno de los paraísos sexuales del Continente.

4. Son las mujeres que se conectan a través de la computadora y cámara, a través de la plataforma tecnológica (página webcam) para entretener sexualmente sola o acompañadas a través de computadora y cámara.
5. Es una actividad que va contra la dignidad humana, base de nuestra constitución, las pone en una situación de vulnerabilidad, de sumisión y de mercancía.

Pornography: a "business" between legality and illegality

Colombia is a country in which this type of issue is not discussed, there is talk of the possibility that people can live their sexuality within the framework of what the Constitution allows, but each one understands it in their own way and benefit. While some people take advantage of this lucrative business ignoring their own duties and the rights of those who participate, others tear their clothes because of the immorality of the matter. Some third parties believe that Colombia should address the issue of the legality of webcam pages,(1) since some people consider they are not completely illegal, for others they are legal, but they lack government regulation.

The penal code and the laws are severe on child pornography, but the reality is that the Government does not pay attention to what is really happening in the film studios.(2) These are in “midpoint” because they have not been legalized, but they have not been declared illegal either. In fact, the “activity” of companies that produce pornography in the country is not contemplated in the International Standard Industrial Classification of all Economic Activities. It is essential to define when there is crime or not and begin to make a social problem visible. When this happens, it can be reported and of course, training processes would be started in order to understand the dynamics that are taking place. In fact, the simple announcement of “the following program is suitable for… It does not contain scenes of sex or violence, the younger ones must be accompanied by parents or responsible adults” must demand further legislative development of the issue.

When referring to regulation, it is thought that these places do not become a risk of a number of crimes, especially women trafficking for the purpose of slavery and sexual exploitation, abuse, extortion, physical, moral and psychological damage, exploitation of children and adolescents. Providing guarantees because tolerated or semi-legalized businesses, with the clandestine nature that they enjoy for the most part, make criminality have a productive scene for these and other crimes.

It could be understood that the regulation for the pornographic industry is specific because it is not an ordinary activity, especially if the risks it contains and how susceptible its content can be to minors are taken into account; But the lack of legal and economic regulation opens a way for bad practices that even the government itself has taken advantage of. It may seem unprecedented to anyone that in the complicit silence of an “activity” where it is difficult to give an opinion because of the fine thread between what legal and illegal is; applies a tax that collects money from webcam models(4) for the State and at the same time that it becomes an accomplice of this type of pornography. Stating that the tax is a way of regulating the business and is a morally harmful activity(5) that must be regulated to decrease.(6)

The regulation begins to visualize this type of establishments, it is not the same a store that offers sex toys, sexually explicit images, films or pornographic videos to the webcam pages that offer live exhibitions. The requirements for these adult entertainment businesses are different even if we meet the right to freedom of speech.(7) The lack of laws violates not only moral barriers but also the standards of protection of children and adolescents, it endorses the operation of websites with pornographic content, no matter how obscene the material offered to the public is. The obscene and pornographic must be evaluated and regulated just as the guarantees for women. The illegality of these spaces relies in the fact that this type of scenario is totally unprotected by the State, which should be a guarantor of human rights; it is a shame that Colombia continues to be one of the continent's sexual paradises.
